Outcome Of Appeal – Melinda Kinny (Racing NSW Appeal Panel)

Melinda Kinny - Before the Racing NSW Appeal Panel

Licensed jockey Melinda Kinny lodged an appeal against penalty after being found guilty by Racing NSW Stewards under AR81A(1)(a), following a urine sample obtained from Ms Kinny on 27 May 2018 after her ride at Goulburn earlier that day.

Following a Stewards inquiry on Tuesday, 24 July 2018, Ms Kinny was suspended for a period of nine months backdated to 3 July 2018 (on which day she was stood down by the Stewards) and to expire on 3 April 2019.

The appeal was heard on Friday 2 November 2018 by the Racing NSW Appeal Panel presided by Mr R. Beasley SC at the offices of Racing NSW commencing at 10am.

The Panel gave the following orders:
1. Appeal against severity of penalty allowed.
2. The Panel notes the appellants license was suspended in full from 3/7/18 for 9 months. From today (2/11/18) that suspension is varied such that the appellant may ride trackwork and trials.
3. Appellants suspension further varied to expire on 2/12/18, on which day she may resume race riding.
4. Appeal deposit refunded.
