Licensed Jockey Tommy Berry lodged an appeal after being found guilty of offences under AR115(1)(b) x 2, AR218(4)(b), AR218(4)(c) and AR228(a) x 2 at a Racing NSW Steward’s inquiry held on Tuesday, 17 January 2023.

Following the Stewards inquiry, Mr Berry was disqualified for a period of 11 months and 2 weeks to commence 17 January 2023 and to expire at midnight on 31 December 2023.

Stewards further ruled that the penalty associated with two of the charges - AR218(4)(b) & AR218(4)(c) be served concurrently and at the conclusion of the period of disqualification imposed on Mr Berry.

Accordingly, that period of suspension commences on 1 January 2024 and expires at midnight on 28 January 2024.

On the application of the appellant Mr Tommy Berry, which was not opposed by the Stewards, he was granted a Stay of Proceedings by the Appeal Panel until resolution of the appeal, or further order.

A date for the hearing of the appeal is yet to be set.
