Racing NSW Stewards concluded an inquiry into the alleged conduct of licensed jockey Clayton Gallagher following the running of Race 6 (Macquarie Geotech Benchmark 66 Handicap, 1000m) at the Dubbo Turf Club meeting on Saturday, 2nd November 2024.
On that day evidence was taken from Clayton Gallagher, apprentice jockey Ms Shayleigh Ingelse, Clerk of Scales Robert Brown and Stipendiary Steward Xavier Dalton.
Stewards, having taken further evidence from Clayton Gallagher and considering all the evidence, subsequently issued the following charge against Mr Clayton Gallagher:
Charge: AR228 Improper Conduct
The particulars of the charge being that when weighing in following the running of Race 6 at the Dubbo Turf Club meeting on Saturday, 2nd November 2024, he did conduct himself improperly by directing an inappropriate comment toward apprentice jockey Shayleigh Ingelse when present in the weighing room and while in the vicinity of industry participants and officials.
Plea: Guilty
Penalty Considerations
The following penalty considerations were taken into account:
- Guilty plea
- Objective seriousness of the conduct
- Mr Gallagher’s disciplinary record which includes various conduct-related offences
- Mr Gallagher’s personal and professional circumstances
- Principles of specific and general deterrence and what message is sent to the industry in respect to such conduct
- The purpose of issuing penalties as a protective measure for the image, interests and welfare of the thoroughbred racing industry
Penalty
Stewards determined that Mr Gallagher’s licence to ride in races be suspended for a period of 3 weeks to commence on Monday, 11 November 2024 and to expire on Monday, 2 December 2024, on which day he may ride.
Mr Gallagher was advised of his rights of appeal.
