Outcome Of Appeal - Licensed Jockey Chad Lever

Chad Lever – Before the Racing NSW Appeal Panel

Licensed Jockey Chad Lever lodged an appeal against conviction and penalty after being found guilty by Racing NSW Stewards under AR135(b) after his ride on Streets Of Dubai in Race 4 (Lear & Smith – Rexel Group Benchmark 58 Handicap 1506m) at Port Macquarie Racecourse on Sunday 23 September, 2018.

Following a Stewards inquiry on Sunday 28 October, 2018, Mr Lever was suspended for a period commencing Wednesday, 7 November 2018 and to expire on Friday, 7 December 2018 on which day he may ride.

On application of the Appellant, which was not opposed by the Stewards, the penalty imposed by Stewards is stayed until further order of the Panel.

This appeal was heard on Friday, 16 November 2018 by the Racing NSW Appeal Panel presided by Mr T. Hale SC at the offices of Racing NSW commencing at 11.00am.

The Panel gave the following orders:

1. Appeal against finding of breach of AR135(b) allowed.

2. Finding of breach of AR135(b) set aside.

3. Penalty of one month suspension set aside.

4. Appeal deposit to be refunded.
