Racing NSW is a specialised insurer licensed under the provisions of the Workers Compensation Act 1987 (NSW) to provide workers compensation insurance to certain employers (racing clubs and licensed trainers) in the NSW thoroughbred racing industry. The workers of those employers and jockeys injured in the course of their employment will have an entitlement to claim workers compensation in accordance with the provisions of both the aforementioned Act and the Workplace Injury Management and Workers Compensation Act 1998. Schedule 3 to the Workers Compensation Regulation 2016 sets out the terms and conditions of the policy of insurance that apply to an employer’s liabilities under the Workers Compensation Act 1987.
Racing NSW has engaged the services of the independent provider Gallagher Bassett to assist with the claims and injury management of all claims within the Racing NSW scheme. Gallagher Bassett is among the world’s largest third-party claims administrators and operate extensively in all workers compensation jurisdictions within Australia. The engagement of Gallagher Bassett has been supported and approved by the State Insurance Regulatory Authority of New South Wales.
Since 1 July 2022, Gallagher Bassett has, in partnership with Racing NSW, managed the claims of all injured workers who fall within the coverage of the Racing NSW Scheme. Notwithstanding the outsourcing of the claims management function, Racing NSW continues to be the licensed specialised insurer for all relevant participants within the NSW thoroughbred racing industry and remains responsible for all workers compensation matters. Gallagher Bassett will work closely with Racing NSW to continue to provide employers and workers with assistance and support for in the administration of the claim and the worker’s injury management and sustainable return to work.

Racing NSW will continue to directly manage all non-claim related functions under its Specialised Insurer Licence including the determination of workers compensation premiums.
