Racing NSW is constituted by the Thoroughbred Racing Act 1996 No. 37 ("the Act") as amended by the AJC Principal Club Amendment Act 1997. The Act was originally assented to on 25th June 1996 and was described therein as:
"An Act to make provision for the establishment, management and functions of the AJC Principal Club (later amended to Racing NSW) as the representative body to control thoroughbred horse racing in the State; and for other purposes."
